These Terms of Service apply to the Service, including the Keivi sales management software and the Keivi Application.
Keivi notes that when using specific Keivi Services and Features, You must comply with these Terms of Service as well as the separate terms and conditions applicable to such Service and Feature. Keivi may change or amend these Terms of Service and will notify You of such change or amendment from time to time; You may view the newly updated information at any time at www.keivi.com.
Your continued use of the Service following notification constitutes your agreement to abide by the updated Terms of Service. You may contact Keivi for clarification regarding any changes or amendments to these Terms of Service. Keivi respects your right to terminate the Service Use Agreement at any time should you disagree with any changes or amendments to these Terms of Service.
Any breach by You of these Terms of Service that You cannot explain or remedy within a reasonable period notified by Keivi may, subject to the provisions of the Service Use Agreement between You and Keivi, result in the temporary suspension, suspension, or termination of the account, the Service, or other activities in accordance with the Service Use Agreement.
You must acknowledge and accept that You are responsible for using the Service for service business purposes in accordance with the applicable laws and the fine customs and traditions of Vietnam. You must not use the Service to disseminate depraved content, to oppose the State, to violate the law, to distribute spam and/or inaccurate or false information, or information intended to defame or negatively affect other organizations and individuals in any form.
The Website www.keivi.com, the Service, and the Keivi Application are under the copyright of KIOTVIET TECHNOLOGY CORPORATION.
All content on the Website www.keivi.com belongs to Keivi. For clarity, where the Account Owner uses the “Sell online” Feature or a similar Feature to create the Account Owner’s website, the Account Owner shall be deemed the sole owner of, and shall bear all legal liability for, all content, images, goods, and services posted on such website.
Keivi permits You to view, download, and print Content where (i) it is used for personal, non-commercial purposes; (ii) the Website content is not modified; and (iii) the source from the Website is duly cited. Except as permitted above, You may not copy, adjust, or reuse the Website content without the prior written permission of Keivi. To request the use of Content, You may contact: hotro@kiotviet.com.
If approved, You must ensure that Your use of the Website content does not infringe the rights or interests of other individuals/organizations and must clearly cite the source as www.keivi.com.
You are responsible for safeguarding the information used to access the Store to avoid the account being stolen and/or misused for purposes unsafe for both You and Keivi. Keivi is not responsible for the unauthorized intrusion by a third party (including Keivi’s employees) into Your Store due to Your negligence. Keivi recommends that You change Your password after providing the password to relevant parties for the purpose of usage support. In addition, Keivi undertakes to comply with the regulations on data protection with respect to the information of You and Your Store.
You are responsible for notifying Keivi immediately upon detecting an incident and for actively coordinating with Keivi to remedy it as soon as possible for You. In the event that the incident relates to a Third Party, You are responsible for coordinating with the relevant parties to resolve it. In all cases, Keivi always endeavors to provide support and remedy in accordance with the Service Use Agreement; however, Keivi will not be responsible for damages arising from Your delay in notification, failure to notify, or concealment, or from force majeure events for objective reasons not arising from Keivi’s fault. Where necessary or as required by law or a competent State authority, Keivi may report the incident to the competent State authority so that the State authority may monitor or remedy it in accordance with the law.
Keivi will not be liable or jointly liable for consequences and damages caused by reasons beyond Keivi’s reasonable control or by force majeure events, relating to (i) unauthorized access to the server, Website, Keivi sales management software, or Keivi Application; (ii) Your equipment and data or Your customers’ data being subject to incidents or being used by unlawful means or by a Third Party’s device; and (iii) other events occurring during the use of the Service.
Because You may use Keivi’s Service to do business with Third Parties, Keivi will not be liable to such Third Party for damages relating to the profits or business opportunities of such Third Party. Keivi will not be liable for damages or costs arising directly or indirectly to You from connecting to the Website or using Keivi’s Services, except where such damages arise from Keivi’s fault and Keivi has failed to take reasonable and necessary measures to mitigate such damages.
Keivi recommends that You research partners carefully before proceeding with any cooperation in order to avoid unwanted damages. Keivi does not warrant, nor is it responsible for, Your business results after using the Service.
The Website, the Services, and the Features are provided on an “as available” basis. Keivi does not warrant that the Website, Service, or Feature will always be available, usable, uninterrupted, timely, or error-free at all times, as there may be various objective causes that could have an effect. However, Keivi and its employees undertake to endeavor, in all conditions and to the extent possible, to ensure that the Website, Service, and Feature are always ready to serve Your needs as conveniently as possible.
You should note that the operation of the Website and the provision of the Service are based on Internet transmission services and may be subject to power outages or interruptions, external attacks, and delays. In such cases, Keivi undertakes to make efforts to remedy the interruption and to make adjustments, repairs, and replacements to the extent possible and reasonable to restore the system.
You may access and look up the guides at the User Guide page or at the Tutorial Videos page. The user guide documents are sent by Keivi in soft-copy form together with the account confirmation email immediately after You successfully register an account.
Keivi has the right to manage, exploit, and use the Common Area on the Website at Keivi’s decision and discretion to ensure the smooth operation of the Website in providing the Service to customers. Your requests to use the Common Area on the Website for Your own purposes may be charged in addition to the service fee stipulated in the Service Use Agreement.
You have full rights to use the password-protected Private Area for Your activities. Keivi does not interfere with, and is not responsible for, Your operations affecting the data and information in the Private Area. Any request arising in the use of the Private Area that is not within the initial commitment may be charged in addition to the service fee stipulated in the Service Use Agreement.
Keivi has the right to access Your Private Area where (i) Keivi has obtained Your consent; (ii) the purpose of access includes: usage support; incident handling; upon Your request; and to serve emergency situations, to prevent unauthorized intrusion or destructive attacks from outside; or upon the request of a competent State authority; and (iii) Keivi fully complies with the regulations on personal data protection during the access.
You do not have the right to access, and do not have the right to request access to, the Private Area of Keivi, the Private Area of another Account Owner, the Service administration area, or the system and administration of the Website.
Keivi encourages You to contact the Keivi Customer Support Center directly at Keivi’s head office or via the hotline 1900 6522 from 8:30 a.m. to 9:00 p.m. every day when You need support, have questions, or wish to make a complaint.
You may use the tool in the Contact section to submit specific requests in the event that the hotline or telephone contact channels are unavailable.
Administrator Account information after successful registration of the Store, automatic notifications from the system, and password-change / forgotten-password confirmations are sent to You via OTP through Zalo, SMS, or the email hotro@kiotviet.com. Any automatic notifications from other sources are not reliable; in the event You receive an email that does not come from the above sources, Keivi recommends that You contact the Customer Support Center immediately for assistance.
Keivi recommends that You only send Store Data information to the email hotro@kiotviet.com for the purpose of support and deployment. Keivi does not guarantee that Your Store Data will be kept confidential if You send it to an email other than the email stated in these Terms of Service or to the personal email of an employee, collaborator, or agent of Keivi.
The Keivi brand, the Keivi logo, etc., have been registered as exclusive trademarks of Keivi in Vietnam. Keivi has the lawful right to supplement and adjust the list of these brands and trademarks from time to time. You must not register, whether intentionally or unintentionally, any trademark or logo that is similar and may cause confusion with, or is identical to, the trademarks and logos that have been registered exclusively. You must comply with all standards set for the Keivi brand and the Keivi logo when using them and must use them in accordance with Keivi’s regulations.
In the event that any provision of these Terms of Service becomes invalid or unenforceable for any reason, the validity of the remaining provisions shall not be affected. If there is any discrepancy between these Terms of Service and the Service Use Agreements, the most recent provision shall prevail, unless otherwise provided by law.
If You have downloaded the Keivi Application from the Application Store, the following terms shall additionally apply and take effect:
These Terms of Service constitute an agreement between You and Keivi, and not with the Application Store. Keivi is solely responsible for the Keivi Application. You understand and agree that the Application Stores have no obligation to provide maintenance services or to support You in using the Keivi Application;
When using the Keivi Application, You understand and agree that we have the right to use system APIs to access the data on Your phone for the following purposes: (1) reading from and writing to the phone contacts; (2) obtaining Your current location; (3) writing Keivi Application data to the memory card; and (4) accessing the Internet from Your device. All such access is only carried out by us with Your consent;
The Keivi Application installed on Your device has an operating mode even when Your device is offline; Keivi does not guarantee that the data You are viewing on the Keivi Application is the most up-to-date data of the system. Therefore, You understand and ensure that Your device is connected to the network when You need to access the most up-to-date business data;
You are responsible for keeping the device and/or devices on which the Keivi Application is installed within Your control and in a safe condition; Keivi is not responsible where Your business data is stolen or misused due to Your negligence;
You must comply with the terms of service of the Application Store, including the usage rules.
Linked Services are value-added services, whether charged or not charged, provided by Keivi and a Third Party, which Keivi and the Third Party cooperate to provide to users of the Keivi sales management software or the Keivi Application.
Before using a Third Party’s Linked Service, You should review the terms of service of the Linked Service. When You use a Third Party’s Linked Service, You shall bear all responsibility relating to the use of the Linked Service provided by such Third Party. In the event that You agree to use the Linked Service, Keivi only shares the information and data that You have agreed to share and that is necessary for the Third Party to provide the Linked Service. You may refer further to the terms of service of the Third Party’s Linked Service for the information and data shared by the Third Party when using the Linked Service.
Keivi will request You to provide basic data including the following:
when You register to use Keivi’s Service, and certain other information and data (if any) when You wish to interact with certain content on the Keivi Website and Application.
Keivi will only collect, use, disclose, store, and/or process this information and data with Your consent and where necessary for legitimate and lawful purposes serving Your interests during the use of Keivi’s Service. When You access, register for, and use Keivi’s Service, You should follow the provisions of our privacy policy; this privacy policy may be updated or amended pursuant to our notice to You, and You may follow the newly updated privacy policy at any time at www.keivi.com.
You shall be responsible for the security and safekeeping of all activities of using the Service under the registered Account Owner name, password, email inbox, and/or phone number. Keivi is not responsible for any loss of data or breach of confidential information of the customer caused by the customer, whether inadvertently or intentionally.
In addition, customers are responsible for promptly notifying Keivi of any unauthorized use, misuse, breach of security, or unauthorized retention of the registered name and password by a third party so that appropriate resolution measures can be taken.
As a personal data subject, You have the basic rights of a personal data subject, including but not limited to the rights to (i) be informed of personal data processing activities; (ii) consent or not consent to, and request the withdrawal of consent to, the processing of personal data; (iii) access, edit, or request the editing of personal data; (iv) request the provision, deletion, or restriction of the processing of personal data, and submit a request objecting to the processing of personal data; (v) file complaints, denunciations, and lawsuits, and claim compensation for damages in accordance with the law; and (vi) request the competent authority or the agencies, organizations, and individuals involved in personal data processing to implement measures and solutions to protect their personal data in accordance with the law. The exercise of these rights shall depend on Keivi’s policy from time to time on the basis of compliance with the relevant provisions of law. You may contact Keivi at the information in Section 2.5 to better understand the rights of a personal data subject when using the Service.
As a personal data subject, You have the basic obligations of a personal data subject, including but not limited to the obligations to (i) protect Your own personal data; (ii) respect and protect the personal data of others; (iii) provide full and accurate personal data in accordance with the law, under the contract, or when consenting to the processing of Your personal data; and (iv) comply with the law on personal data protection and participate in the prevention of, and combat against, acts infringing personal data. You may contact Keivi at the information in Section 2.5 to better understand the obligations of a personal data subject when using the Service.

In all cases, the customer’s information will be kept secure on Keivi’s servers and stored in accordance with the law. Customers have full rights under the law with respect to this information. In certain cases, subject to the customer’s consent and in accordance with the law, Keivi may use such information from Keivi’s database to resolve disputes, enforce the terms of use, or for technical or legal requirements relating to the safety and operations of Keivi in accordance with the law.

You have the right to self-check, update, and adjust your personal information by logging into your account and editing the Account Owner’s information, or by coming directly to the head office, or contacting Keivi via the Hotline or email at the information in Section 2.5 above for Keivi’s guidance.
You have the right to file a complaint regarding the disclosure of personal information to a third party with Keivi’s Management Board at the information in Section 2.5 above. Upon receiving such feedback, Keivi will check and review the information relating to the complaint. In the event that the disclosure of personal information is due to Keivi’s fault, Keivi will discuss with You to resolve the complaint in accordance with the law.
Keivi undertakes to apply appropriate managerial, technical, and organizational measures to protect the Account Owner’s data in accordance with Keivi’s information protection policy and the applicable laws on data protection and personal data protection.
The collection and use of each customer’s information is only carried out with the lawful consent of that customer, except where otherwise provided by law. Keivi undertakes to:

Apply appropriate protective measures to all online transaction information of customers, including invoice information, digitized accounting documents, and related data stored and processed on Keivi’s system. These measures may include access authorization, access control, logging, information-security monitoring, backup/recovery, vulnerability management, periodic security testing, and other protective measures appropriate to the nature of the data and the processing risks.
